1. Scope
These terms and conditions apply to the use of parking facilities managed by Gulur bíll ehf., or another operator specified on signs at the respective parking facility.
These terms apply to everyone who drives a vehicle into the parking area, parks a vehicle there, or registers a vehicle for a parking permit, subscription, or other service.
Special rules, price lists, and information on signs at individual parking lots form part of these terms. If special provisions on signs or in an agreement regarding the relevant parking facility differ from these general terms, the special provisions shall take precedence.
2. Acceptance of Terms
By driving into or parking a vehicle in the parking area, the user accepts these terms, the parking fee schedule, and the rules displayed on signs at the site.
Users are required to familiarize themselves with sign markings, pricing, maximum duration, payment methods, and other rules before parking. If a user cannot accept these terms, they must leave the area without undue delay.
The driver is responsible for informing the owner or operator of the vehicle about the use of the parking facility and any resulting payment obligation.
3. Use of Parking Facility
Vehicles must be parked within marked spaces and in such a way that they do not obstruct traffic, access, emergency routes, services, or the use of other parking spaces.
It is strictly prohibited to:
- park outside of marked spaces;
- park in driving lanes, near entrances/exits, or in front of emergency exits;
- park in spaces reserved for persons with disabilities without a valid permit;
- park in charging spaces unless the vehicle is actively charging, if specified by signage;
- park in reserved spaces without proper authorization;
- store unregistered, non-operational, or abandoned vehicles in the area;
- use the parking lot for repairs, sales, storage, or other activities without written consent;
- cause danger, inconvenience, noise, pollution, or damage.
Users must follow traffic signs, surface markings, height restrictions, and staff instructions.
4. Vehicle Registration and Camera Reading
In parking areas equipped with automatic camera recognition (ANPR), the vehicle's license plate is scanned upon entry and exit. Parking duration is generally calculated from the recorded entry time to the recorded exit time, unless otherwise specified on signs.
The user is responsible for ensuring that the correct license plate number is registered during payment, in the mobile application, at the payment terminal, via subscription, or for a parking permit. Incorrect or insufficient registration may result in payments or permits not being found by the system.
Camera recognition does not guarantee that a parking permit is active. The user is personally responsible for ensuring that payment has been successfully processed and that the permit is valid.
If the camera fails to read the license plate or if a technical failure occurs, the user must follow alternative payment or registration methods indicated on-site.
5. Parking Fee
Parking fees are charged in accordance with the price list published on signs, in the payment system, or on the website of the respective parking facility.
Fees may be calculated based on:
- duration of stay;
- time of day;
- 24-hour periods or other timeframes;
- vehicle type;
- subscription, permit, or special agreement.
Users must complete payment within the time limit specified on signs or in the payment system. Payment is not considered complete until confirmed by the payment system.
If the pricing structure includes a free grace period, payment obligations become active once that period expires. A free period does not exempt users from other parking rules.
6. Payment Methods
Available payment methods may include payment terminals, online payments, mobile applications, credit cards, invoicing, subscriptions, or other methods indicated on-site.
The user is responsible for:
- registering the correct license plate number;
- verifying that payment has been approved;
- retaining receipts or confirmations where applicable.
If a payment method fails, the user must attempt another available method or contact Gulur bíll customer service. Failures in mobile phones, internet connections, apps, or payment mediums do not automatically cancel payment obligations.
7. Subscriptions and Parking Permits
A subscription or parking permit grants only the rights specified in the respective agreement or registration. Such permits do not guarantee an available space unless explicitly stated.
Permits are generally tied to a registered vehicle, license plate number, user, company, time period, or designated parking space. Transferring or sharing a permit is prohibited unless explicitly authorized.
The user is responsible for ensuring vehicle information is correct and up to date. Changes to license plates do not take effect until confirmed in the relevant system.
The operator reserves the right to suspend or cancel subscriptions or permits in cases of payment defaults, misuse, or breach of terms, following prior notice where applicable.
8. Non-Payment and Rule Violations
If parking fees are not paid on time, or if a vehicle is parked in violation of rules, the operator may charge the unpaid parking fee along with additional, notification, and collection costs in accordance with published terms, price lists, and applicable laws.
Claims may be sent to the owner, registered keeper, renter, or other responsible party as permitted by law and available information.
In cases of default, the claim may be transferred to a collection agency. Default interest and collection costs will then accrue according to applicable laws.
Serious or repeated violations may result in the vehicle or user being denied access to the operator's parking facilities.
9. Removal of Vehicles
To the extent permitted by law, the operator may request the removal of a vehicle if it is parked in a manner that:
- causes danger or significant obstruction;
- blocks entry/exit routes or emergency access;
- occupies a reserved space without authorization;
- appears abandoned or non-operational;
- is parked in severe violation of the terms.
Costs related to lawful removal or storage of a vehicle may be charged to its owner or keeper in accordance with applicable laws.
10. User Liability
The user is responsible for their own vehicle, items contained within it, and any damage caused by them, their passengers, or their vehicle to people, other vehicles, equipment, structures, or the surrounding parking environment.
Users must lock their vehicles and secure them to prevent hazards. Valuables should not be left visible inside the vehicle.
The operator must be notified without undue delay of any damage caused to parking equipment or structures. This does not replace notifications to police, insurance companies, or emergency services where applicable.
11. Limitation of Operator Liability
The parking facility is leased or provided for use as a vehicle standing space. The operator does not take vehicles into custody and acts neither as a custodian nor as an insurer of the vehicle or items inside it.
To the extent permitted by law, the operator is not liable for:
- theft from a vehicle or theft of a vehicle;
- vandalism or damage caused by third parties;
- collisions or damage caused by users to one another;
- damage caused by weather, ice, snow, water, fire, natural disasters, or other events beyond the operator's control;
- damage resulting from items, equipment, or conditions that were visible and which the user could reasonably have avoided;
- operating losses, loss of income, loss of use, or other indirect or consequential damages.
However, the operator is liable for direct and proven damage attributable to the culpable conduct of the operator or its staff, provided liability cannot be limited under mandatory laws.
Nothing in these terms limits liability for intentional misconduct or gross negligence by the operator, nor does it limit statutory consumer rights or other liabilities that cannot be excluded or restricted by law.
The operator does not guarantee that an empty parking space will always be available unless explicitly guaranteed through a written agreement.
12. Closures and Disruptions
The operator reserves the right to temporarily close a parking facility or parts of it due to maintenance, construction, safety, snow removal, events, or other operational reasons.
The operator is not liable for temporary disruptions or inability to use the facility due to events outside their reasonable control. Users will be informed of planned closures with reasonable notice where circumstances permit.
13. Cameras and Privacy
During parking operations, license plate numbers, photographs, entry and exit times, payment information, contact details, and other necessary information may be processed for operations, safety, payments, collections, and dispute resolution.
The processing of personal data complies with applicable data protection laws and the operator's privacy policy. The privacy policy details processing purposes, legal bases, retention periods, data recipients, and data subjects' rights.
The privacy policy is available at www.gulur.app/en/privacy.
14. Complaints and Adjustments
Comments or complaints regarding payments, registrations, or claims must be sent to customer service as soon as possible and within 30 days of the payment or claim date.
The following information must be included where applicable:
- vehicle license plate number;
- date and estimated entry/exit times;
- name or location of the parking lot;
- invoice or claim number;
- receipt or payment confirmation;
- a brief description of the incident.
A complaint does not automatically stay the due date of a claim unless explicitly confirmed by the operator. If a claim is found to be incorrect, it will be canceled or adjusted.
15. Changes to Terms and Pricing
The operator reserves the right to amend terms and pricing. Changes will be published on the website or via signs at the respective parking lot before taking effect.
Changes to active subscriptions or long-term contracts will be notified with the notice period specified in the agreement or by law.
The version of the terms in effect at the time the parking facility was used applies to that specific parking usage.
16. Assignment and Subcontractors
The operator may engage service providers for specific operational tasks, such as payment systems, camera recognition, customer service, billing, and debt collection.
Such entities are bound by appropriate confidentiality, security, and data protection obligations.
17. Force Majeure
The operator is not liable for defaults or disruptions caused by force majeure events, including natural disasters, severe weather, fires, power outages, telecommunications failures, strikes, government orders, or similar events.
18. Governing Law and Dispute Resolution
These terms and the use of the parking facility are governed by Icelandic law.
The parties shall seek to resolve disputes through amicable agreement. Consumers may, where appropriate, contact relevant arbitration boards or complaints committees.
If a dispute cannot be resolved, it shall be settled by Icelandic courts in accordance with general venue rules. This provision does not restrict consumers' statutory rights to bring cases before another competent dispute body or court.
19. Severability
If any individual provision of these terms is held invalid or unenforceable, it shall not affect the validity of the remaining provisions. Instead, a provision that comes closest to the purpose of the invalid provision and complies with law shall apply to the extent possible.
